dc.description.abstract | Yabancı para olarak kararlaĢtırılan kira bedelinin belirlenmesi konulu yüksek lisans tez çalıĢmam da, genel olarak kira sözleĢmesinin tanımı, esaslı unsurları, kiracı ve kiraya verenin hak ve yükümlülükleri incelenmiĢtir. Devamla; yabancı para ve memleket parası ayırımı dikkate alınarak, 6098 sayılı Türk Borçlar Kanunu hükümleri ıĢığında, yabancı para kira bedelinde uygulanacak artıĢ oranı, tarafların anlaĢmalarının geçerliliği, kira bedelinin belirlenmesi (tespiti), uyarlama davasının özellikleri ve süreci, kira sözleĢmesinin sona ermesi halleri aynı zamanda mülga 818 sayılı Borçlar Kanunu ve 6570 sayılı Gayrimenkul Kiraları Hakkında Kanun hükümleri ile de karĢılaĢtırma yapılarak incelenmiĢtir. | tr_TR |

dc.description.abstractol | In my master thesis study on the determination of the rent price which is fixed as foreign currency, the description of the rent contract, its essential elements, the rights and obligations of the tenant and the leaseholder are examined. Besides that; taking the difference between domestic and foreign currencies into consideration and in accordance with the provisions of the Turkish Debt Law numbered 6098, comparisons are made regarding the former (cancelled) Turkish Debt Law numbered 818, Compared to the provisions of Law on Real Estate Leases No. 6570 relating the issues of the increase rate of rent price in foreign currency, the validity of the agreement of parties, the designation of the amount of the rent price (the determination), the characteristics and the process of the case for the adaptation of the rent price, termination of the rent contracts. | tr_TR |
